Volume I of NIDAN’s ADR Landscape Report brings together three research papers by the ADR Landscape Project interns on how institutional design shapes dispute resolution in India. The first examines merger control in banking, asking what it means that the Central Government both owns public sector banks and holds the power to exempt their mergers from CCI review, and proposes sunset limits and consultation duties ahead of the exemption’s expiry in 2027. The second considers India’s position as a signatory, but not yet a party, to the Singapore Convention on Mediation, and sets out what ratification would require of domestic law. The third looks at algorithmic bias in AI-assisted selection of arbitrators and mediators, and recommends disclosure, human decision-making and regular audits. Each paper pairs doctrinal analysis with concrete reform proposals.
